Terms of Service — BrandForge OS

1. License

Each purchase of BrandForge OS grants you a perpetual, non-transferable license to use the software on any device you own or control (the software is installed and run locally; there is no device registry or activation). “Perpetual” means you keep access as long as the product exists; we commit to maintaining and releasing updates for at least 24 months from purchase. The Solo tier is limited to one (1) user; the Agency tier includes multi-client white-label use for your own client work; the OS tier adds the resell rights described in the Reseller License.

1b. Hosted subscriptions (hybrid cloud)

BrandForge OS Hosted is an optional cloud service with Free, Pro, and Agency plans. Free is limited (e.g. campaign caps and watermarks). Paid hosted plans are billed as subscriptions via Paddle unless stated otherwise. We may suspend hosted access for abuse, non-payment, or security risk. Hosted content may be deleted after account closure per our Privacy Policy. Desktop one-time licenses (Solo / Agency / OS) are separate: they grant a perpetual license to run the software on machines you control, subject to the EULA tier scope — they are not the same as a hosted subscription.

2. What is NOT included

• You may not redistribute, resell, or share the software itself (except under the OS tier resell license).
• You may not use BrandForge OS to build a competing product or service.
• API keys you connect (Groq, Gemini, Ollama, etc.) are subject to those providers' own terms and pricing. BrandForge OS does not resell model access.

3. AI-generated content

All campaign output is AI-generated draft material. You are responsible for reviewing and approving all content before publishing. You are solely responsible for compliance with advertising law, platform policies, trademark and copyright in your jurisdiction. We recommend fact-checking any claim (numbers, testimonials, pricing) before use.

4. Privacy & offline operation

By default, BrandForge OS runs on your machine. Campaign data, client profiles and memory files never leave your computer unless you connect an online AI provider, in which case the prompts you send are transmitted to that provider. See the Privacy Policy.

6. Warranties & liability

The software is provided “as is” without warranty of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid for your license.

7. Termination & changes

We may update these terms with 14 days' notice for material changes. Continued use after changes means you accept them. If you breach these terms we may revoke the license; your previously generated files remain yours.
